The requirements

EB-1A requires sustained national or international acclaim — shown through awards, memberships, publications, judging, media, salary, or original contributions. EB-2 NIW weighs whether your endeavor has substantial merit and national importance, whether you are well positioned, and whether waiving the job offer is appropriate. PERM asks the employer to recruit first and prove no qualified U.S. worker was available.

EB-1A or NIW — which fits me?

The strongest standard your record can meet. EB-1A requires sustained acclaim across at least three of its ten criteria; the NIW weighs merit and national importance, your position to advance the work, and the benefit of waiving the job offer. We map your evidence against both and recommend.

Can I file both at the same time?

Yes. EB-1A and NIW are separate petitions and can be filed in parallel, each with its own filing fee. An option we use when the EB-1A is a stretch, not a default.

How fast is premium processing?

The I-907 asks USCIS for action within 15 calendar days — a decision, a request for evidence, or a notice of intent to deny. It accelerates review; it does not change the standard.
